WHEREAS, On May 5, 1913, said Commission passed an order,
known as Order No. 1183, approving said consolidation and
authorizing the issuance and exchange of stock as provided in
said agreement of consolidation; and,
WHEREAS, It is desirable that said consolidation and issuance
and exchange of stock be ratified and confirmed; now, therefore,
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the consolidation of The Frederick and Hagerstown
Power Company, the Hagerstown Railway Company of Wash-
ington County, Maryland, the Hagerstown and Myersville Rail-
way Company, the Hagerstown and Boonsboro Railway Com-
pany, the Myersville and Catoctin Railway Company of Fred-
erick County, the Frederick Railroad Company, the Frederick
Gas and Electric Company, corporations of the State of Mary-
land, and the Hagerstown and Northern Railroad Company, a
corporation formed by the consolidation of the Hagerstown and
Northern Railway Company, a corporation of the State of Mary-
land, and the Franklin County Railroad Company, a corpora-
tion of the Commonwealth of Pennsylvania, be and the same is
hereby ratified and confirmed; said consolidation having been
effected under an agreement of consolidation dated April 7,
1913, and recorded on April 18, 1913, in the office of the State
Tax Commissioner at Annapolis, in Liber B. S. No. 6, folio 403,
&c., and in the office of the Secretary of State, in Railroad Rec-
ord No. 4, folio 19, &c., and on April 19, 1913, in the Clerk's
Office of the Circuit Court for Frederick County, in Records of
Corporations No. 3, folio 195, &c., under which agreement of con-
solidation The Hagerstown and Frederick Railway Company
was formed.
SEC. 2. And be it further enacted, That the issuance and
exchange of common and preferred stock of The Hagerstown and
Frederick Railway Company, aggregating two million one hun-
dred and sixty-two thousand five hundred dollars ($2, 162, 500),
for a like amount of common and preferred stock of the con-
stituent companies, theretofore issued, be and the same is hereby
ratified and confirmed.
SEC. 3. And be it further enacted, That nothing contained in
this Act is intended or shall be taken or construed as relieving
the said The Hagerstown and Frederick Railway Company from
the provisions of Chapter 180 of the Acts of the General Assem-
bly of Maryland of 1910, known as the Public Service Commis-
sion Law, or any amendment thereto.
