1680 LAWS OF MARYLAND.

partments, setting forth in detail the amount required for the
purposes, uses and needs of each and every department of the
city government. And in no one year shall the Mayor and Coun-
cilmen expend in and upon any department of the city govern-
ment a sum larger than the amount appropriated to the needs
thereof in the said budget. Any expenditures made in violation
of this Section shall be deemed a malfeasance on the part of
said Mayor and Council.

SEC. 192. The Mayor and Council shall appoint regular
Policemen not exceeding twenty-five and the Mayor shall des-
ignate one of the number as Captain and another as Lieu-
tenant. The said policemen shall serve under such regulations
and for such compensation as the Mayor and Council may direct,
such compensation, however, not to exceed eighty dollars per
month and not to be less than fifty dollars per month, and said
policemen shall be subject to removal for cause. The Mayor
shall have the power to appoint special policemen if in his
judgment the exigencies of the city shall require it, provided,
however, that the term of appointment of such special police-
men shall not exceed a period of thirty days. The fire marshal
and assistant fire marshals, provided for by ordinance of the
Mayor and Council of Hagerstown, for the more effectual dis-
charge of their duties and the protection of property, shall,
during the time of fires, have all the powers of a policeman of
the City of Hagerstown, and said fire marshal and assistant fire
marshals shall take the oath prescribed for policemen of said
city, and shall serve without pay.

SEC. 3. And be it further enacted, That Sections Four (4),
Five (5), Six (6), Seven (7), Eight (8), Eleven (11), Thirteen
(13), Fourteen (14) and Fifteen (15) of Chapter 75 of the Acts
of the General Assembly of Maryland of 1900 be and the same
are hereby repealed and re-enacted with amendments so as to
read as follows:

SEC. 4. That the Mayor and Council are hereby authorized
and empowered, for the purpose of this Act, to purchase or
lease land, either improved or unimproved, within the limits of
Washington County, Maryland, in the name of the Mayor and
Council of Hagerstown, and to erect, change or alter such
buildings thereon as may be necessary, or advisable in the
opinion of the said Mayor and Council, and to purchase and con-
tract for all other things necessary to complete the plant and
equipment authorized by this Act, which said plant and equip-
