1198 LAWS OF MARYLAND.

street or alley, or any part thereof, in said town, in such man-
ner and with such material as the Mayor and Council may
deem fit and proper, and shall be entitled to collect the whole
expense and cost of such grading, paving or otherwise improv-
ing the same, or any portion thereof, from the owners of the
property binding or abutting upon such street or alley, or upon
which or in front of which said grading, curbing and paving
shall be done; provided, however, that the owner or owners of
the property upon which, along which, or in front of which such
grading, paving or curbing may be done, shall be responsible
for and shall pay to the Mayor and Council the actual cost of the
grading, curbing, paving, excavating, filling and the construc-
tion of any retaining walls, actually placed on, along, or in
front of his, her or their property, together with his, her or
their proportion of the general cost of superintending, survey-
ing and managing said work; and provided, further, that in
case any sidewalk or street is graded, paved or curbed under
the provisions of this Section, the Mayor and Council shall first
pass an ordinance providing in detail the method and manner
of such grading and paving, the grade thereof, and the material
to be used, including the width of the sidewalk and such other
information as may be necessary in order to give the property
holders along said street, and the people generally, information
and notice as to the improvement intended to be made; and
provided, further, that said ordinance shall be open to the in-
spection of all persons interested therein and copies of the same
shall be posted or tacked in at least two public places on the
street intended to be improved, and provided, further, that the
Mayor and Council shall not proceed with the improvement of
said street until said ordinance shall have again been passed
by the Mayor and Council at a meeting to be held not less than
thirty days from the meeting at which said ordinance was first
passed, and provided that all persons interested in said ordi-
nance or affected by it shall have the right to appear before the
Mayor and Council and be heard before the second passage of
said ordinance. And when any sidewalk, street or alley or any
part thereof shall have been graded, paved, curbed or otherwise
improved in accordance with the provisions of this Section,
then the Mayor and Council shall have the right to collect the
cost thereof from the owners of the property binding or abut-
ting on such sidewalk, street or alley, in accordance with the
provisions of this Section, by civil suit at law. And whenever
the Mayor and Council shall levy or assess any sum of money
