CHAPTER 30.

4, 1862.

AN ACT to repeal the second and third sections
of the Code of Public Local Laws of Montgomery
county, entitled "Alms House," and to'enactin
lieu thereof the following sections, providing for
the annual election of Trustees of the Poor and
for other purposes :

Annual ap-
pointment of
the Trustees of
the Poor.

SECTION 1 Be it enacted by the General Assembly
of Maryland, That the Commissioners of Mqnt-
gomery county shall, in the second week of Novem-
ber, in every year, appoint five persons, inhabi-
tants of said county, Trustees of the Poor of said
county, who shall hold their office of Trustees for
the term of one year from the date of their appoint-
ment, and until their successors shall have been
appointed and qualified; provided, that the said
Commissioners shall have the power to remove all
or any of such Trustees at their pleasure ; and
whenever a vacancy shall exist in said Board of
Trustees from any cause, it shall be the duty of the
said Commissioners to fill such vacancy at their
next meeting.

Overseer of
the Poor — hit
duties, &c.

Sec. 2. And be it enacted, That whenever a va-
cancy shall exist in the office of overseer of the
Poor, either by the expiration of the time for which
he was appointed, or by removal, the overseer
whose appointment shall so become vacant, shall,
upon the order, and at the appointment of said
Trustees, deliver up to the said Trustees the pos-
session and custody of the Alms House, and all the
property and effects of every description thereto
belonging; and upon his neglect or refusal to do
so, it shall be the duty of the Sheriff of the county,
upon the request of said Trustees to remove him
therefrom.

Duty of Clerk
to Trustees.

Sec. 3. And be it further enacted. That whenever
the office of Clerk of said Trustees shall become va-
cant either by lapse of time or removal, it shall be
the duty of the Clerk whose appointment has so be-
come vacant, to deliver to the said trustees all books,
papers, monies or other property in his custody as
said Clerk, and if he shall neglect or refuse so to
do upon the demand of the said Trustees, said Clerk
shall forfeit the sum of ten dollars for each and
