CHAPTER 104.

AN ACT to incorporate a company for the estab-
lishment of a Public Cemetery in Kent county,
and within a mile of the exterior limits of Ches-
tertown.

Passed March
3, 1862.

WHEREAS, It has been made apparent to this Gen-
eral Assembly that a Cemetery, or place of
burial, is necessary for the inbabitants-of Ches-
tertown and its vicinity, and for the purpose of
effectuating the wishes and intentions of the said
citizens.

Preamble.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That George Vickers, Samuel W.
Spencer, Edward Wilkins, James B. Ricaud, John
T. Dood, Anderson W. Meloin, Dr. James A.
Perking, John L. Stam, John W. Collins, Simon
Wickes and William A. Vickers, of Kent county,
and their sucessers, be and the same are hereby
created a body politic and corporate, by the name
and title of the Chester Cemetery, and by that
name shall have perpetual succession , and be able
to sue and be sued, before any Justice of the Peace
and in any court of law or equity in this State,
and shall have and use a common seal, and shall
have power to purchase and hold real estate not
exceeding twenty acres, with authority to said cor-
poration to receive and take donations of land,
money or personal estate, and conveyances duly
executed for the same, not exceeding twenty-five
thousand dollars in the aggregate, and to sell, dis-
pose of and convey any such real or personal estate,
or any part thereof, for the purpose of providing a
place of interment for the dead and of adequate-
ly securing, adorning and embellishing the said
grounds and Cemetery.

Incorporated.

Sec. 2. And be it enacted, That the affairs and
business of the said company or corporation shall
be conducted by a President and Five Managers,
the first board to hold their offices for two years,
and until their successors shall be elected, and in
case of any vacancy the said President and Mana-
gers, or a majority of them, shall have power to
fill such vacancy, whether such vacancy be occa-
