CHAPTER 67.

 

AN ACT to add sections one hundred and eigh-
teen, one hundred and nineteen, one hundred
and twenty, one hundred and twenty-one and
one hundred and twenty-two to Article eighteen
of the Public Local Laws for St. Mary's county,
authorizing Trustees of school districts to pro-
cure sites for school houses by gift, devise, pur-
chase or condemnation.

11, 1864.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the following sections, under
the head of "School," be added to Article eigh-
teen of the Code of Public Local Laws for St. Ma-
ry's county, to authorize the Trustees of school dis-
tricts to procure sites for school houses by gift,
devise, purchase or condemnation :

118. The Trustees of any school district may
procure by gift, purchase or devise, a site, not ex-
ceeding five acres of land, for the erection of a
school house within their respective districts, a due
regard being had to centrality of location and other
conveniences necessary to a public school.

119. If the Trustees of any school district shall
not be able to procure by gift, purchase or devise,
a suitable site for a school house, they may con-
demn a site not exceeding one acre, having due
regard to the rights and interests of the owner or
owners of land sought to be condemned, and con-
fining such condemnation in all cases, unless im-.
practicable, to the outer borders of the tract or
parcel of land from which said condemed site shall
be selected.

120. In all cases in which it shall be necessary
to condemn a site, the Trustees shall cause to be
served on the owner of the land to be condemed a
notice in writing, signed by at least a majority of
a full Board, of the place and time of viewing
and condemning such site, and they shall assess the
value and damages; and such condemnation and
assessed value and damages shall be approved and
certified to by a majority of a full Board; and the
