sioners, or a majority of them, that the said turn-
pike road has been properly made, is in good
traveling condition, and in all respects constructed
in conformity to this act, the said County Com-
missioners shall issue a license to the said company
to erect a toll-gate on the said turnpike road, or
on such part thereof as the said company may
deem proper, at which may be charged and col-
lected by a toll gatherer, appointed by the said
company, such tolls as are hereinafter prescribed.

Sec. 7. And be it enacted, That the said com-
pany shall be authorized and empowered to charge
and receive, as tolls on the said road, the same
rates of toll as are now allowed by law to be re-
ceived by the Woodsborough and Monocacy Turn-
pike Road Company in Frederick county; and the
said company is hereby clothed and invested, with
all and -singular, the powers, rights, immunities
and privileges not inconsistent with the provisions
of this act, for the purpose of enforcing the collec-
tion of the tolls herein authorized as are now
allowed by law to the several turnpike companies
in said county.

Rates of toll.

Sec. 8. And be it enacted, That the said com-
pany are hereby authorized to purchase and occupy,
for the purpose of a gate keeper, not more than
one-half acre of ground contiguous to the line of
said road, at such point as they may select for a
toll-gate; and in the event of their inability to
obtain the same by consent of the owner thereof,
it shall be lawfulfor the said company to sue out
of the Circuit Court for Frederick county an inqui-
sition for the assessment and valuation of said one-
half acre of ground; and upon the compliance by
said company with the finding of the jury in such
inquisition, by the payment, or tender in payment,
to the owner thereof, the amount prescribed, to-
gether with all costs and charges thereon, it shall
and may be lawful for the said company to occupy
and possess the said piece of ground for the pur-
pose aforesaid.

Sec. 9. And be it enacted, That no dividend out
of the earnings of the said company shall be de-
clared unless the said turnpike shall be kept in
good repair and condition for travel, and the ques-
tion of dividend shall be determined by the stock -
