and preservation of said road and the running of
cars and the transportation of passengers or freight
thereon, and for the transaction of all other busi-
ness of said company as in their judgment may be
necessary.

Compelled to
buy.
|
Sec. 12. And be it enacted, That the company
hereby incorporated shall be compelled to buy of
the owner or owner's of any omnibus lines now
running the coaches, horses and harness used on
that part of any turnpike which hereafter may be
occupied by said railway; and so soon as the said
railway "shall be in operation, and upon ten days
notice by the owner or owners of any omnibus
line, the said owner or owners and the said rail-
way company shall each select one person to value
said property, and the two persons so selected
shall select a third person to act with them, and
shall proceed at once to assess the value of the
coaches, horses and harness, and make an award
of the value of the same, which shall be binding
(except in case of fraud) upon the said owner or
owners, and upon the said company, and the said
company shall forthwith pay the amount so as-
sessed to the said owner or owners, and shall here-
after become the owner of said coaches, horses and
harness.

Banking priv-

Sec. 13. And be it enacted, That nothing in this
act contained shall be so construed as to authorize
said company, or its agents or office's, to issue any
scrip or bank notes, or exercise any banking privi-
leges, and the State hereby reserves to itself the
right to amend or repeal this act at pleasure.

Road be com-
pleted in one
year.

Sec. 14. And be it enacted, That the said com-
pany shall commence the construction of said road
within one year, and complete the —— within
three years from the passage of this act, or the
same shall be null and void.

In force.
|
Sec. 15. And be it enacted, That this act shall
take effect from the date of its passage.
