tended, would pass said stream, and to gravel,
curb and pave the road leading from the termina-
tion of Baltimore street, in the direct line thereof
to the Garrison Forest road, running between the
Calverton Turnpike road and the Baltimore and
Frederick Turnpike road, and to change the grade
of the Calverton Turnpike road where it crosses
Gwynn's Run.

Sec. 2. And be it enacted. That the said commis-
sioners be and they are authorized to contract with
some suitable person or persons for making the
improvements aforesaid, and to assess and appor-
tion the costs of "the said improvements on the
State of Maryland and the holders of property on
the line of said improvements in the following
proportions, that is to say, one-half of such costs
to be paid by the State of Maryland, and the
other one-half to be paid by the said property

holders, in proportion to the benefits accruing to
said property from the said improvements; pro-
vided, that in no case shall the State of Maryland
be required to pay more than the sum of ten thou-
sand dollars for said improvements; and provided
also, that no allowance shall be made to any of
said property holders for any land required for the
bed of said street or road, or for any earth, rock
or other material taken from their property on,
adjacent to, or in the vicinity of the line of the
said street or road.

Provisos.

Sec. 3. And be it enacted, That the said com-
missioners be and they are hereby required to take
from the constructor or constructors aforesaid, a
bond to be given to the State of Maryland, by
him or them, with a sufficient surety or sureties
in the penalty of double the price to be paid him
or them for the said work, and conditioned for the
faithful performance of the contract entered into
by him or them, and on any default made by the
said contractor or contractors in the performance
of his or their contract aforesaid, the said bond
shall be put in suit, and the damages recovered
thereon shall be distributed to the said State and
to the said property holders in the proportions be-
fore mentioned.
