CHAPTER 157.

Passed Feb.
19, 1864.

AN ACT to add a section to Article ninety-three of
the Code of Public General Laws, entitled "Tes-
tamentary Law," to be numbered three hundred
and twenty-nine, relating to the receipt and
custody, by the Register of Wills, of the wills
of living persons.

Section added.

SECTION. 1. Be it enacted Ity the General Assem-
bly of Maryland, That the following section re-
lating to the receipt and custody by Registers of
Wills of the wills of living persons, be added to
Article ninety-three of the Code of Public General
Laws, entitled "Testamentary Law," and be ar-
ranged as section three hundred and twenty-nine,
under the head of Wills in said article:

Register to
receive for safe
keeping.

329. Every Register of Wills in this State shall
receive, for safe keeping, the will of any living
person who resides in the city or county for which
such Register is appointed, every such will being
first sealed tip and endorsed with the name of the
testator, its date, and the date of its delivery to
the Register, and the name of the executor or
other person to whom it may be delivered at the
death of the testator; and such Register shall re-
ceive for each will so deposited fifty cents, and
shall immediately index it in an index to be kept
for that purpose, and there keep it in his, office in,
a depository to be kept for that purpose, until the
death of the testator, unless delivered to such tes-
tator or to his order, in his lifetime, upon a re-
ceipt therefor being given on said index.

In force.

Sec. 2. And be it enacted, That this act shall
take effect from the date of its passage.
