allowed by law for similar service, and for re-filing
anew causes of action, trial and other papers or
re-copying dockets or docket entries, such sum, as
the Commissioner appointed by this act, shall deem
right and proper, and such payments shall be
made to said Clerk by the County Commissioners
of Baltimore county, monthly, upon the certificate
of the Commissioner appointed by this act, setting
forth that he has examined the recording and
other work ordered by him, and that the same has
been properly done, and that the amount charged
is in conformity to the allowance prescribed by the
provisions of this act, and for the outlay for books,
stationery, and for binding books, the said Clerk
shall present hip account accompanied with vouch-
ers and verified by his. affidavit to the said County
Commissioners, and upon such presentation, they
shall pay him, such amount as he has actually ex-
pended.

Sec. 15. And be it enacted, If any excess of fees
should accrue in the office of the Clerk of the Cir-
cuit Court for Baltimore county during the time of
carrying into effect and executing the provisions
of this act, the said Clerk is hereby authorized and
directed to credit the work required to be done by
the preceding section with such excess of fees; and
such excess of fees, if any should accrue, are hereby
appropriated to that object, and the Comptroller
of the State is hereby directed to settle the amounts

and credits of the said Clerk accordingly; and
provided, if any excess of fees should accrue, the
said Clerk shall receive six cents, instead of seven
cents, for each hundred words or figures recorded,
and pro rata, and for indexing three-fourths of the
amount, instead of the full amount, now allowed
by law for similar service, and such payments
shall be made as hereinbefore provided for.

Proviso.

Sec. 16. And be it enacted, That the expenses
allowed to the Commissioner appointed by this act
shall not be more than ($5) five dollars per diem,
to be paid to him by the County Commissioners of
said county, monthly, upon the certificate of the
Clerk of the said Commissioner, made under oath,
as to the number of days which the said Commis-
sioner shall have attended, and the compensation
of the Clerk shall be ($3.50) three dollars and fifty
