of such charges.

Sec. 9. And be it enacted. That the said com-
pany shall have true and trusty agents, captains
and servants, and that all grain, marketing or
other articles of merchandise, and for every de-
scription of property committed to their care the
company shall hold themselves liable — the dangers
of the sea and fire alone excepted.

Liability.

Sec. 10. And be it enacted, That nothing in this
act shall be construed to impair the rights, of any
person or persons to an action against said com-
pany, their agents, workmen or servants, for any
damage done to his, her or their property or per-
sons.

Conditions.

Sec. 11. And be it enacted, That the Presidqnt
and Directors of the said company shall cause a
report to be made annually (or semi-annually if
they shall deem it expedient) to the stockholders
of said company, showing the amount expended
by said company in the purchase or construction
or chartering of boats, or in the purchasing, leas-
ing, erecting or construction and repairing of
boats, vessels, wharves, warehouses or other houses
or structures, the amount of passage and other
monies, freights and all other monies received, and
the amount of expenses incurred; during the same
period exhibiting a full and fair account of debit
and credit; and that the said President and Direc-
tors shall annually or otherwise, at such times and
places as the by-laws of said company shall direct,
make and declare a dividend of the nett profits of
said — , and cause the same to be paid over to
the parties or persons respectively entitled.

Sec. 12. And be it enacted, That the President
and Directors shall, as soon as practicable after
the organization of the said company, pay to the
said Commissioners a per-diem allowance for the
time they may be engaged in the duties required
by this act, of three dollars for every day, and
shall also provide and pay for all printed notices
in newspapers, all other necessary expenses that
may be incurred by said Commissioners.

Sec. 13. And be it enacted, That nothing in this
act shall be so construed as to authorize the said
