hundred and sixty-five.

CHAPTER 161.

AN ACT to repeal section one hundred and eight
of Article seventeen of the Code of Public Local
Laws, entitled, Queen Anne's County, and en-
act in lieu thereof the following, relating to
public roads and gates :

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That section one hundred and
eight of Article seventeen, entitled, Public Local
Laws for Queen Anne's County, be and the same
is hereby repealed, amended and re-enacted, so as
to read :

Sec. 108. Be it enacted by the General Assembly
of Maryland, That any person having a gate on
any of the public roads- in Queen Anne's county,
shall pay annually a tax of not less than two nor
more than fifty dollars for every such gate, in the
discretion of the County Commissioners, and it is
hereby made the duty of said Commissioners to
publish for three successive weeks, in two of the
newspapers of largest circulation in said county, a
list of all the gates on the public roads, together
with the names of the owners, and the amount of
tax assessed on each, in parallel columns, which
said tax the owner will be required to pay annu-
ally, so long as said gate shall continue an obstruc-
tion to travel, and these taxes shall be collected in
manner provided for in the subsequent sections of
this Article.

where new roads are laid down, and an appropri-
ation made by the County Commissioners to pay
the cost of fencing on both sides of said road, or
