sureties, to be approved by the Governor, and be
in all respects on a footing with other State Col-
lector's bonds, as provided, in section thirty-four,
and the said Collector shall have all the powers of
other Collectors.

AN ACT to secure the completion of the Mary-
land and Delaware Railroad Company.
|
Lien waived.
|
SECTION 1. Be it enacted by the General Assembly
of Maryland, That the lien held by the State on
the property qf the Maryland and Delaware Rail
road Company, to secure the payment of the six
per cent, interest out of the profit of the work or
the stock held by the State in said company, be
and the same is hereby waived, postponed and
deferred in favor of the holders of any bonds which
it may be necessary to issue for the completion
and equipment of said work, and of no other
parties whatsoever, not exceeding one million
dollars, the said waiver to take effect whenever a
bona fide contract shall be made, by which the
opening of no less than two-fifths of said road will
be effected, said contract to be approved by the
Board of Public Works, and said approval to be
made known by proclamation of the Executive of
the State.

issue warrant.

Sec. 2. And be it enacted, That the Comptroller
of the Treasury, be and he is hereby authorized
and directed to issue his warrant to the Treasurer
for the payment to the Maryland and Delaware
Railroad Company of the residue of the appropria-
tion heretofore made by the State, as the same
may be called for by said company, provided said
payment by the State shall not exceed the amount
which has been previously paid by other parties,
including contributions in work, land or materials,
as may be shown from time to time by the certifi-
