Sec. 22. And be it enacted. That any person or
persons having possession of any bill of sale, mort-
gage or other instrument of writing, relating to
personal property that appears to have been here-
tofore recorded in the office of the Clerk of the
Circuit Court for the said county, and the record
thereof has been destroyed, may have the same en-
rolled again, and the Clerk of the said court is here-
by require to record the same, together with the
endorjement thereon, of the former enrollment at
the cost and expense of the party or parties re-
quiring the same, and the same when recorded
shall have the same effect and operation in law, to
all intents and purposes, as if the records afore-
said, in which the said papers were heretofore re-
corded had never been destroyed.

Sec 23. And be it enacted, That this act shall
take effect from the date of its passage, and all acts
or parts of acts, inconsistent with this act be, and
the same is hereby repealed.

AN ACT to incorporate the Empire Coal Com-
pany, of Allegany county

SECTION 1. Be it enacted by the General Assembly
of Maryland, That James A. Ferguson, John
Rhind and Charts B. Thurston, and such other
persons as may become associated with them, in.
the manner, hereinafter provided, shall be and
they are hereby constituted a body corporate and
politic by the name of the Empire Coal Company
of Allegany county, and by that name shall have
succession and be able and capable to sue and be
sued in any court whatever, and may have and
use a common seal and the same alter and renew
at pleasure, and shall have all the powers, facul-
ties, franchises and rights necessary and proper
for the carrying on the mining of coal and the
beneficial management of its property, and for the
