the stockholders, and in all meetings of said
President and Directors a majority of said Presi-
dent and Directors, shall constitute a quorum for
the transaction of business.

rights and
powers.

Sec. 6. And be it enacted, That the said com-
pany, be and the same is hereby invested with all
and singular the rights, powers and authority
necessary to enable it to locate, construct and
maintain such rail road or rail roads, as the Direc-
tors may deem necessary for the convenient trans-
action of its business, which said rail road or fail
roads, may connect with any other rail road in
Allegany county, on the Chesapeake and Ohio
Canal within the limits of Allegany county, and
for these purposes, the said company shall be and
is hereby invested with all and singular the rights,
powers, immunities, franchises and privileges for
the surveying, locating and constructing of such
rail road or rail roads, and for the working, re-
pairing, preserving and controling the same, and
the necessary vehicles and appurtenances thereto
belonging, and every part thereof, which by the
act, and more particularly the fifteenth section
thereof, incorporating the Baltimore and Ohio
Rail Road Company and the several supplements,
for the lawful purposes of said company, and the
benefits of its corporators, given, granted, author-
ized and secured to the said Baltimore and Ohio
Rail Road Company, and to the President and
Directors thereof respectively, as fully and par-

ticularly as if the same were herein repeated; pro-
vided, that no private property shall be taken for
the use of said company without just compensa-
tion as agreed upon between the parties, or award-
ed by a jury, is first paid or tendered to the party
entitled to such compensation, and all costs and
expenses which may accrue in consequence of the
condemnation of any such private property; and
the said company hereby incorporated shall trans-
port upon any rail road or rail roads, which the
said company may construct under the provisions
of this act, all persons and property at the same
rate of toll and prices of transportation as the
Baltimore and Ohio Rail Road Company are or
shall be, by law authorized to charge, and receive.

Sec. 7. And be it enacted, That nothing herein
contained shall be construed to give to said com-
pany banking privileges.
