CHAPTER 30.
AN ACT to require the Baltimore and Ohio Railroad Company,
a public service corporation, incorporated under the laws of
the State of Maryland, to continue and maintain safety
gates at the crossing of the railroad of the said Baltimore
and Ohio Railroad Company of the county road known as
the Baltimore and Washington turnpike, in Howard County,
State of Maryland, at the village of Elkridge, in said county,
where the said railroad crosses the said county road, known
as the Baltimore and Washington turnpike, and for a watch-
man, or watchmen, at the said crossing day and night, at the
expense of said company, as long as said railroad crosses the
said turnpike at grade.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Baltimore and Ohio Railroad Company, a public
service corporation, incorporated under the laws of the State
of Maryland, be required to continue and maintain safety
gates at the crossing of the railroad of said Baltimore and Ohio
Railroad Company over the county road known as the Balti-
more and Washington turnpike, at the village of Elkridge, in
said Howard County, where the said railroad crosses the
county road known as the Baltimore and Washington turnpike
aforesaid, and to provide a watchman, or watchmen, at said
crossing, day and night, at the expense of said railroad com-
pany, as long as said railroad crosses the said county road on
turnpike at grade.
SEC. 2. And be it enacted, That a failure of the said Balti-
more and Ohio Railroad Company to comply with the pro-
visions of this Act shall be deemed a misdemeanor, and, on
conviction before any Justice of the Peace of Howard County,
Maryland, shall be subject to a fine of ten dollars ($10) for
each and every day after the passage of this Act that provisions
of Section 1 hereof are not complied with; and said fine shall
be collected by issuing of a fieri facias and sale of the property
of the Baltimore and Ohio Railroad Company aforesaid for
the payment of the fine and costs, as small debts are collected
in Maryland. And all fines collected shall be paid over to the
County Commissioners of Howard County for the use of the
county roads of said county. And provided further, that either
party may appeal from judgments of the finding of the Justice
of the Peace to the Circuit Court for Howard County.
SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.
