office when the time for conveying the property has arrived,
his successor then in office, may convey the same.

120B. When the County Commissioners shall order suit
upon a collector's bond, they shall transmit to the State's At-
torney or some other attorney selected by them a statement of
the account of said collector, and upon the account so trans-
mitted, signed and certified by the treasurer of said county, and
on motion being made on behalf of the State or of the State
for the use of the County Commissioners, judgment shall be
entered at the first term of the Court in which suit is brought
against such collector and his sureties, and execution shall is-
sue as in other cases; provided, ten days' previous notice in
writing of such motion, and of the amount for which it is to be
made, be served on such collector and his sureties, or be left at
their place of abode, signed by said attorney; and it shall be
the duty of the sheriff to serve such notice, and proof of such
service shall be made to the satisfaction of the Court before
such judgment shall be entered; provided, nevertheless, if at
the time of the institution of the suit, the collector or his sure-
ties or any of them do not reside in said county, or if they or
any of them are then absent from the county, such previous
notice of said motion and a summons may be served on such
non-resident or absentee by the sheriff of Dorchester County,
whenever he can find such party, and may be served on any
such party, by the sheriff of any county of this State; and pro-
vided, in case of the death of the collector or any of his sure-
.ties, the provisions of this section shall apply to the executor
or administrator.

121. If such collector or sureties, or the executor or admin-
istrator, shall in person or by attorney, desire trial by jury of
any matter in controversy in said suit, which shall be pleaded
by them, the Court shall thereupon at said first term direct a
jury to be impaneled to try and determine the matter in con-
troversy.

12lA. The Treasurer of Dorchester County and Clerk, sub-
ject to the approval of the County Commissioners, shall be en-
titled to appoint such assistants, deputy or deputies as he may
deem necessary and proper for the faithful and efficient per-
formance of the work and duties of his said office. Provided,
that the compensation for such assistant or assistants, deputy
or deputies shall be fixed with the approval of the County Com-
missioners, but not more than the aggregate sum of seven hun-
dred dollars shall be paid by the county to such assistant or
deputies, however many may be appointed. Each assistant or
deputy before he enters upon the discharge of his said office
shall take and subscribe the official oath directed by the State
