charge of said sinking fund, divert or apply, or suffer to be
diverted or applied, any one or more of said sums of one
hundred and fifty dollars that ought to be set aside as afore-
said for said sinking fund, or said sinking fund, to any other
purpose than the redemption of the said bonds to be issued
hereunder, then such President or Commissioners, who shall
so fail to set aside said sum of one hundred and fifty dollars so
annually to be raised, or by their vote agree to such applica-
tion or diversion to such other purposes, shall be deemed guilty
of a misdemeanor and shall be subject to a fine of not less
than the amount so diverted, and upon failure to pay said fine
and costs, may, in the discretion of the Court trying said case,
be committed to the county jail of Cecil county aforesaid in
the State of Maryland until said fine and costs are paid.

SEC. 6. And be it enacted, That this Act shall take effect
from the date of its passage and that any legislation contrary
thereto is hereby repealed.

CHAPTER 556.

AN ACT to repeal Section 85 of Article 8 of the Code of Public
Local Laws, title "Cecil County," sub-title "Chesapeake
City," as enacted by the Act of Assembly of 1908, Chapter
545, and to re-enact the same with amendments.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 85 of Article 8 of the Code of Public Local
Laws, title "Cecil County," sub-title "Chesapeake City," as
enacted by Section 85, Chapter 545, of the Acts of 1908, is here-
by repealed and re-enacted to read as follows:

85. The President and Commissioners of Chesapeake City
shall consist of five persons, a President and four Commission-
ers, who shall be citizens of the United States, and at least
twenty-five years of age, and who shall be bona fide residents
of said town of Chesapeake City for at least two years next
preceding the date of this election and who shall each in his
own right own real or personal property situated in limits of
said town assessed at not less than five hundred dollars; said
board shall be nominated at a public meeting to be held two
weeks prior to the election in said town, and no man who is
not nominated at said meeting shall be eligible for election as
President or Town Commissioner. All male inhabitants of
said town who are citizens of the United States who shall re-
side in said town for six months, and in the State of Maryland
