City of Cumberland. The Mayor shall be the bona-fide owner
of property to the value of not less than one thousand dollars
($1,000), and assessed for the same on the tax books of the
said city at the time of his election and for two years next
prior thereto, the taxes on which shall not be in arrears; each
Councilman shall be the bona-fide owner of property to the
value of five hundred dollars ($500), and assessed for the same
on the tax books of the said city at the time of their election
and for two years next prior thereto, the taxes on which shall
not be in arrears; and the said Mayor and City Councilmen
shall hold office for a period of two years from the first Mon-
day in April next succeeding their election, and until their
successors shall have been duly elected and qualified.

SEC. 102. The Mayor shall be President of the City Council.
The said Mayor and Councilmen shall take an oath before the
Clerk of the Circuit Court of Allegany County to faithfully
perform the duties of their offices, and each Councilman shall
receive as compensation for his services, beginning June 1, the
sum of twelve hundred dollars ($1,200) per annum, payable
in equal monthly instalments; the Mayor shall receive a salary
of fifteen hundred dollars ($1,500) per annum, payable in
equal monthly instalments, and the said Mayor shall devote
at least six hours a day to the duties of his office and to the
affairs of the said city.

SEC. 103. That the Mayor and each Councilman, before.
entering upon the duties of his office, shall give bond, payable
to the State of Maryland, for the use of the Mayor and the City
Council of Cumberland, in the sum of five thousand dollars
($5,000), conditioned for the faithful performance of his duty,
with two or more good and sufficient sureties, to be approved
by the Clerk of the Circuit Court for Allegany County, and
shall, in addition to taking the oath prescribed by the Consti-
tution of the State of Maryland and laws thereof, also take
the oath that he is not under direct or indirect obligation to
appoint or elect any person to any office, position or employ-
ment under said government.

The said Mayor and City Council shall, by a majority vote of
all the members thereof, have the power to appoint all officers
and subordinates in all departments of the city.

SEC. 105. Resignation by the Mayor or any Councilman
elected under this Act shall be made in writing to the Mayor
and City Council for their action therupon. In case of the
removal of the Mayor or any Councilman from the territorial
limits of said city, such removal shall ipso facto be deemed to
create a vacancy in his office. In case of any vacancy from any
cause in the office of Mayor, or any Councilman, the Mayor
