which said Commission is described in Section 19 of this
Article, be and the same are hereby transferred from the said
Commission, the State Geological and Economic Survey, and
imposed upon and given to the State Roads Commission,
created by Act of the General Assembly of Maryland, Chapter
141 of the Acts of 1908, or any amendments thereto, together
with all accounts, records, contracts, obligations, unexpended
balances, and all property and things appertaining to the same,
and to the said State Geological and Economic Survey, which
said last-named Commission shall continue to have authority
with reference thereto after this Act shall take effect for the
purpose of making the transfer and delivery hereby authorized
and directed of the said accounts, records, contracts, obliga-
tions, unexpended balances, and all property and things apper-
taining to the same as aforesaid, in a proper and orderly
manner for the protection of the interests of the State, to the
State Roads Commission, and upon making such transfer the
said State Geological and Economic Survey shall prepare and
duly certify to the State Roads Commission a statement of all
amounts and balances due from it under lawful contracts and
accounts, and of all unexpended balances due to it, together
with a list and description of its account and record books and
property; and all Acts of the General Assembly referring to
the State Geological and Economic Survey as the Commission
set forth in Section 1 of this Article, and to any of its powers
and duties transferred hereby to the State Roads Commission,
shall thereafter be taken and held to refer to the State Roads
Commission and the powers and duties conferred upon it.
Whenever any Board of County Commissioners of any county
in this State shall, by resolution, have declared their intention
to cause any particular road, or section thereof, within such
county, to be built or improved under the provisions of this
subtitle, such board shall notify said State Roads Commission
by written notice to the Chairman of said Commission, on or
before the first day of March in each year, and shall request
of said Commission plans and specifications and an estimate'
of the cost of the proper performance of said work according
to said plans and specifications.
SEC. 34. Whenever the owners of two-thirds of the lands
binding upon any public road or section of road, not less than
one mile long, shall present a petition to the county commis-
sioners of the county where such road, or section of road, may
be situated, stating in said petition the desire of said petition-
ers to have said road, or section thereof, constructed or re-
paired under the provisions of this subtitle, and stating further
the willingness of such petitioners to pay for the said con-
struction or repairs a sum equal to ten per centum of the cost
