298 LAWS OF MARYLAND.

Orphans' Court or a judge of the Circuit Court for his county,
if he be elected for a county, or by two judges of the Orphans'
Court of Baltimore City, or a judge of the Superior Court of
Baltimore City, if he be elected for said ,city, with condition
that he shall well and faithfully execute the office of Sheriff of
county or the city of Baltimore, in all things appertaining
thereto, and shall well and truly perform all the duties re-
quired by law to be by him performed; provided, that the
Sheriffs elected for Somerset, Harford, Calvert, Howard, Car-
roll, St. Mary's, Dorchester, Anne Arundel, Queen Anne's, Wi-
comico, Garrett, Worcester, Montgomery, Kent, Baltimore and
Caroline Counties shall be required to give bond in the penalty
of ten thousand dollars, and for no greater sum.

SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.

ARTICLE XCI.

SURVEYOR AND STATE SURVEY.

CHAPTER 721.

AN ACT to amend Section 32D of Article 91 of the Code' of
Public General Laws of the State of Maryland of 1904, title
"Surveyor and State Survey," subtitle "Public Roads," as
enacted by Chapter 141 of the Acts of 1908, and requiring
bonds given by contractors to cover claims for work done and
material provided in the construction of roads.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 32D of Article 91 of the Code of Public Gen-
eral Laws, entitled "Surveyor and State Survey," subtitle "Pub-
lic roads," as enacted by Chapter 141 of the Acts of 1908, be re-
pealed and re-enacted with amendments so as to read as fol-
lows:

32D. The said Commission, when about to construct or im-
prove in any manner any highway, shall give the County Com-
missioners of each County in which it lies a certified copy of
plans and specifications therefor, and a notice that said Com-
mission is about to enter upon and proceed with the work in
question. Said Commission shall thereupon advertise for at
least two weeks in one or more newspapers published in each
County in which the highway lies, and for three consecutive
issues in at least one daily newspaper published in Baltimore
City, for sealed proposals for the construction or other im-
provements of said highway, accurately describing the same and
stating the time and place for opening said proposals, and re-
