tors and employees appointed by the said Board as it may deem
proper; but such rules and regulations shall be the valid and
legal rules and regulations adopted, or hereafter adopted, for
the execution of the Food and Drug Act of the United States of
June 30th, 1906, so far as such rules and regulations may be
applicable to the duties of said Board under and to the pur-
poses of this Act.
SEC. 140j. That the State Board of Health shall have copies
of this Act printed and shall issue them as far as possible to
persons, firms or corporations manufacturing or selling at
wholesale or retail articles of food or drugs, and shall furnish
the same to all persons, firms or corporations requesting them.
SEC. 140K. That the examination of specimens of foods and
drugs shall be made in the laboratories of the State Board of
Health and under the direction or supervision of such Com-
missioner, appointed as provided in Section 140g, for the pur-
pose of determining from such examinations whether such
articles are adulterated or misbranded within the meaning of
this Act; and if it shall appear from any such examination
that such articles are adulterated or misbranded within the
meaning of this Act, the State Board of Health shall cause
notice thereof to be given to the party from whom such sample
or samples was or were obtained; any party so notified shall
be given an opportunity to be heard under such rules and regu-
lations as may be prescribed as aforesaid, and if it appears to
the State Board of Health that such party should be prose-
cuted, then the State Board of Health shall at once certify
the facts to the State's Attorney of the county or the State's
Attorney of Baltimore city, where the law has been violated,
with a copy of the results of the analysis or the examination
of such article, duly authenticated by the analyst or officer
making such examination, under the oath of such officer, and
it shall be the duty of the State's Attorney to whom the State
Board of Health shall report any violation of this Act, to cause
appropriate proceedings to be commenced and prosecuted in
the courts of the State without delay for the enforcement of the
penalties as in such cases herein provided; after judgment of
the Court, notice shall be given by publication in such manner
as may be prescribed by the rules and regulations aforesaid.
SEC. 140L. For the purpose of making effective the provi
sions of this Act and to provide for the salaries and expenses
of the Commissioner and employees, the sum of fifteen thou-
sand dollars ($15,000) annually, or as much thereof as may
be necessary, is hereby appropriated, payable by the Treasurer
of the State upon warrant of the Comptroller at such time and
in such sums as may be authorized by the State Board of
Health, upon presentation of proper vouchers.
SEC. 140M. The word "person," as used in this Act, shall
