136 LAWS OF MARYLAND.

"Fish and Fisheries," sub-title "Patuxent," so far as they
apply to certain waters in the Patuxent river or its tributa-
ries between St. Mary's and Calvert counties.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 29 and 30 of Article 39 of the Code of Pub-
lic General Laws, title "Fish and Fisheries," sub-title "Patux-
ent," so far as they apply to certain waters in the Patuxent
river or its tributaries between St. Mary's and Calvert coun-
ties, be and the same are hereby repealed and re-enacted with
amendments, so as to read as follows:

29. It shall not be lawful for any person to catch or take
fish in the Patuxent river or its tributaries with purse nets or
seines, except for food purposes, north of a line drawn from
Spencer's Wharf, in St. Mary's county, to Point Patience, in
Calvert county, but it shall be lawful for any person to take
or catch menhaden or alewife fish in said river or its tributa-
ries south of said line with seines and nets to be used in the
manufacture of fertilizer or to be put on the land in the raw
state.

30. Any person wishing to take or catch fish in the Patux-
ent river for food purposes north of the line drawn from Spen-
cer's Wharf, in St. Mary's county, to Point Patience, in Calvert
county, with purse nets, shall make application to a Justice of
the Peace in the county in which he resides for a permit, and
shall make oath or affirmation that he is a resident of said
county, and that he does not intend to catch fish for the pur-
pose of manufacturing into fertilizer or to be put upon the
land in the raw state.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 255.

AN ACT to repeal and re-enact with amendments Sections 79,
83 and 85 of Article 39 of the Code of Public General Laws
of Maryland, entitled "Fish and Fisheries," sub-title "Trout
and Other Fish," as the same was amended and re-enacted
by Chapter 161 of the Acts of 1906, said sections regulating
the size of fish caught in this State.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 79, 83 and 85 of Article 39 of the Code of
Public Generall Laws of Maryland, entitled "Fish and Fisher-
ies," sub-title "Trout and Other Fish," as the same was re-
