ARTICLE XX.

SOMERSET COUNTY.

CHAPTER 581.

AN ACT to fix and regulate the time of taking oysters with the
rake or tongs in the waters of Somerset County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That any resident of Somerset County desiring to take
or catch oysters for sale with rake or tongs in any of the
waters of said county shall first obtain, by application to the
Clerk of the Circuit Court for the said county, a separate
license for every person to be so employed in the manner and as
required by the provisions of Article 72, title "Oysters," sub-
title "Tonging," of the Code of Public General Laws of Mary-
land of 1904, and such license shall take effect only from the
fifteenth day of. September, in the year in which it may have
been obtained, to the twenty-fifth day of April, inclusive, next
succeeding; provided, that such license shall not authorize the
taking 0r catching of oysters in any creek, cove, river, inlet,
bay or sound within the limits of any county other than Som-
erset county, and if any person shall take oysters with rakes
or tongs for sale as aforesaid, without first having obtained
a license, as required by the provisions of this section, he shall,
upon conviction thereof before a justice of the peace of the
county wherein the offense has been committed, be fined not
less than twenty dollars, nor more than one hundred dollars,
and stand committed to the county jail until all costs and fines
are paid; and in any such case the boat or vessel used by him
shall be forfeited and may be condemned, in the discretion of
the judge or justice of the peace, in the manner provided by
Section 24 of Article 72 of the Code of Public General Laws of
this State, title "Oysters," subtitle "Dredging." All persons
taking or catching oysters under the provisions of this Article
shall exhibit their authority for so doing when required by any
official of the oyster police force or other officer of the State.

SEC. 2. And be it enacted, That all Acts or parts of Acts
inconsistent with this Act be and he same are hereby repealed.

SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.
