a time named by the Court the sale shall be confirmed and
shall pass absolute title in fee to the purchaser, his heirs or
assigns, provided the balance of the purchase money shall be
paid into Court within ten days after the time allowed to the
persons interested in the property to pay the taxes, interest,
costs and expenses have expired. As soon as the balance of the
purchase money is paid into Court, the Court shall order the
Clerk to convey the property in fee simple to the purchaser,
his heirs or assigns, absolutely, and all right, title and interest
of all the parties shall pass to the grantee in said deed. No
sale shall be set aside, unless the taxes and interest thereon
shall be paid. If there should be no newspaper published in
Hurlock, any notice required by this Act may be published in
a newspaper printed in Cambridge, Dorchester County, Mary-
land.

CHAPTER 363.

AN ACT to regulate the building and maintenance of joint
fences in Montgomery County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That whenever joint fences have been or may be estab-
lished in Montgomery County, for the mutual advantage of
the owners of adjoining arable lands, each shall keep in good
repair his respective portion thereof in the manner following,
that is to say: Post, rail or plank fences shall be at least four
feet and a half high; wire fences of at least six wires, and
worm fences at least five feet high; and the distance in any
case shall be computed from the base of any embankment on
which the same may be placed.

SEC. 2. And be it further enacted, That if either of the
parties shall refuse or neglect to keep in good repair his por-
tion of said division fence after twenty days' written notice
shall be given to him, his agent, employee, tenant or representa-
tive, by the person aggrieved, the person so aggrieved may
apply to any justice of the peace of said county who, upon
proof of notice aforesaid, shall appoint three discreet and
sound judging freeholders of said county not related to either
party to' hear, and determine all matters in dispute connected
with said fence.
