612 LAWS OF MARYLAND. [CH. 233

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 15 of Chapter 77 of the Acts of 1870, title
"An Act to incorporate the Town of Frostburg, in Allegany
County," is hereby repealed and re-enacted with amendments
so as to read as follows:

Section 15. And be it enacted, That the Mayor and Coun-
cilmen of Frostburg, may, from time to time, cause an assess-
ment to be made of all the property, real and personal, of
every kind and description, in the Town of Frostburg, by
three persons appointed by them, and may levy thereon a tax
not exceeding in any one year seventy-five cents on every hun-
dred dollars' worth of assessable property; and at least one-sixth
of the revenue derived from all the taxes aforesaid, shall be
applied annually by the Mayor and Councilmen of Frostburg
to the payment of the town's floating debt and interest thereon,
until such a time when the same is fully paid, after which the
amount aforesaid shall be used in redeeming the town's bonded
indebtedness and payment of interest on the same. One-sixth
of the revenue derived from the taxes aforesaid may, in the
discretion of the Mayor and Councilmen, be used to construct
and pay for permanent municipal improvements, provided,
however, that so much of the said one-sixth allotment that may
remain after the payment of said improvements shall then be
used in the liquidation of the floating indebtedness and interest
thereon, and the bonded indebtedness and interest thereon, in
the manner and order above set forth.

SEC. 2. And be it further enacted, That this Act shall be
submitted to the qualified voters of the Town of Frostburg at
the town election of the town of Frostburg next after this Act
has gone into effect, and that at said election the question of
increasing the tax rate shall be submitted to the qualified voters
of said town, and that on the ballots provided by the Mayor
and Councilmen of Frostburg at said election there shall be
printed the words, "For Increase of Tax Rate" and "Against
Increase of Tax Rate," with the square after said words in
each case for the X mark of the voter, and the voter may vote
thereon, either by an X mark after his choice or by running a
pen or pencil through the one to which he is opposed; and if
there be a majority of votes cast in favor of said increase in
the tax rate, then the said Mayor and Councilmen of Frostburg
shall be authorized to levy a tax not exceeding in any one year
seventy-five cents on every one hundred dollars' worth of as-
sessable property as hereinbefore provided; and if a majority
