ty," sub-title "Roads," as the same was enacted by Chapter 108
of the Acts of 1912, be and the same is hereby repealed and
re-enacted with amendments so as to read as follows:

Section 167A. The Board of County Commissioners of
Montgomery County shall annually make a general levy of an
amount not exceeding thirty-five dollars ($35.00) per mile for
the repair of the dirt roads in said county, the said amount,
when collected, to be apportioned to the several election dis-
tricts according to the mileage of county dirt roads in each of
said election districts, and in computing said election district
mileage each election district shall be credited with one-half
of the mileage of all county dirt roads constituting boundary
lines between it and other election districts. And said County
Commissioners shall also annually make a general levy of an
amount not exceeding three hundred dollars ($300.00) per
mile for the repairs to macadam or other permanently im-
proved roads with which the county is charged with the duty
and expense of maintenance, said amount, when collected, to
be apportioned to the several election districts according to the
mileage of auch macadam or other permanently improved roads,,
located in each of such election districts, and in computing
said election district mileage of macadam or other perma-
nently improved roads, each election district shall be credited
with one-half the mileage of all the macadam or other per-
manently improved roads, constituting boundary lines between
it and other election districts. And each of said apportion-
ments for repairs to dirt roads and for repairs to macadam
or other permanently improved roads shall be expended wholly .
upon roads within the election districts to which it is appor-
tioned. Any unexpended or surplus part of such apportion-
ment for the repairs to dirt roads may be expended for repairs
to macadam or other permanently improved roads in the elec-
tion district to which it is apportioned, and any unexpended
or surplus part of such apportionment for the repairs of
macadam or other permanently improved roads, and any other
road fund which may be credited to the several election dis-
tricts or any of them and not set apart for some particular pur-
pose, may be expended for the construction of new macadam
or other permanently improved roads in the election district
to which such apportionment or such other fund is credited,
but shall not be expended elsewhere nor for any other purpose.
All monies received by said county for maintenance of roads
from the automobile tax, or from other miscellaneous sources
