SEC. 3. And be it further enacted, That the members of
said Commission shall be a body corporate, by the name of the
"Washington Suburban Sanitary Commission, " with the right
to use a common seal, to sue and be sued, and to do any and
all other corporate acts for the purpose of carrying out the
provisions of this Act. Whenever it shall be deemed neces-
sary by said Commission to take or acquire any land, struc-
tures or buildings, either in fee or as an easement, for the
construction, extension or maintenance of any water main,
sewer or appurtenance thereof, or for any sewage disposal
plant, reservoir, water purification plant, tank or pumping
station, or any stream bed, waterway or watershed, said Com-
mission may purchase the same from the owners, or failing to
agree with the owner or owners thereof, may condemn the
same by proceedings in the Circuit Court for the County in
which said land, structures or buildings are located, as now
provided for condemnation of land by public service corpora-
tions in Article 34 of the Code of Public General Laws of
Maryland, and said Commission may at the same time con-
demn the interest of any tenant, lessee or other person having
an interest in said land. At any time after ten days after the
return and recordation of the verdict or award in said pro-
ceeding, the said Commission may enter and take possession
of said property so condemned, upon first paying to the Clerk
of the Court the amount of said award and all costs taxed to
date, notwithstanding any appeal or further proceeding upon
the part of the defendant; at the time of said payment, how-
ever, it shall give its corporate undertaking to abide by and
fulfill any judgment on such appeal or further proceedings.
SEC. 4. And be it further enacted, That as soon after or
ganization as possible said Commission shall cause purveys,
plans, specifications and estimates to be made for water sup-
ply, sewerage and drainage systems in those portions of the
Sanitary District in which, in its judgment, such systems, or
any of them, are necessary, and shall divide such territory
into water, sewerage or drainage districts in such a way as
shall, in its judgment, best serve the needs of the various com-
munities and shall promote convenience and economy of in-
stallation and operation. Whenever, and as, plans are com-
pleted in those districts most needing service, the Commission
shall give notice, by publication in one or more newspapers
published within the Sanitary District, that said improvements
are contemplated and shall state the probable cost thereof, that
