CHAPTER 115.

AN ACT to repeal Section 24 of Article 10 of the Anno-
tated Code of Maryland, title "Attorneys, " sub-title "State's
Attorney, " so far as the same applies to Garrett County,
and to repeal and re-enact with amendments Sections 216,
217 and 218 of Article 12, Code of Public Local Laws, title
"Garrett County, " sub-title "State's Attorney, " as amended
by Chapter 9 of the Acts of 1890 providing a fixed salary
for the State's Attorney of Garrett County and giving the
said State's Attorney the power to administer oaths in cer-
tain cases.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 24 of Article 10 of the Annotated Code of
Maryland, be and the same is hereby repealed in so far as it
applies to Garrett County, and that Sections 216, 217 and 218
of Article 12 of the Code of Public Local Laws, title "Garrett
County, " sub-title "State's Attorney, " as amended by Chapter

9 of the Acts of the General Assembly of Maryland of 1890,
be and the same are hereby repealed and re-enacted with
amendments to read as follows:

216. The State's Attorney for Garrett County shall receive
an annual salary of eighteen hundred dollars, which salary
shall be paid to him by the County Commissioners of said
County, payable quarterly by warrant on the County Treas-
urer, and it shall be unlawful for him to receive or the said
County Commissioners to pay him any other or further com-
pensation, salary, fee or recompense of any kind, except the
necessary expenses incident to said office, including stationery,
postage and necessary traveling expenses incurred in perform-
ing the several duties of said office. It shall be the duty of the
Sheriff of said County to collect and pay over to said County
any appearance or other fee taxed as part of the costs payable
to the State's Attorney in any criminal case.

217. The State's Attorney for Garrett County, in the con-
duct of the duties of his office and in any investigations which
he may make from time to time relative to violations of law,
shall have the same power which is now vested in Clerks of
the Courts and Justices of the Peace of this State to administer
oaths and to examine witnesses under oath.

SEC. 2. And be it further enacted, That this Act shall take

effect from and after the first day of January, in the year
1920.
