ART. 11.] FREDERICK COUNTY. 805

Town of Myersville, in Frederick County, Maryland," be and
the same are hereby repealed.

SEC. 4. And be it enacted. That this Act shall take effect
from the date of its passage.

Approved April 6, 1908.

CHAPTER 527.

AN ACT to require the Baltimore and Ohio Railroad Company
to place a watchman or flagman at the crossing one-fourth
of a mile below the station at Doubs, Frederick county,
Maryland, to supersede the bell, now employed at that
place by the said company, to warn all those who may have
occasion to use the crossing, of the approach of trains.

Whereas the bell, now in use at the crossing one-fourth of a
mile below the station at Doubs, Frederick county, Maryland,
does not afford sufficient protection to those who use the said
crossing, because of the fact that frequently the said bell
does not ring when the trains are approaching the said cross-
ing, thereby rendering said place exceedingly dangerous for all
who lawfully use said crossing; and

Whereas it is deemed expedient and salutary to improve
upon this defective mode of giving signals, and thus insure
more protection and safety to those who may rightfully use
said crossing; therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Baltimore and Ohio Railroad Company be and
it is hereby required to place a watchman or flagman at the
crossing, one-fourth of a mile below the station at Doubs,
Frederick county, Maryland, to supersede the bell now em-
ployed at that place, by the said company, to warn all those
who may have occasion to use the said crossing of the approach,
of trains; said watchman or flagman to guard the said crossing
during each and every day from 6 o'clock A. M. to 9 o'clock
P. M.

SEC. 2. And be it enacted, That if the said Baltimore and
Ohio Railroad Company shall fail, neglect or refuse to comply
with the provisions of the preceding section, it shall be com-
pelled to pay the sum of fifty dollars for each and every of
such failure, neglect or refusal, to be collected at the suit of
any person aggrieved thereby; one-half of the said sum to be
paid to the plaintiff in said suit, the other half to the Board
of School Commissioners of Frederick county, Maryland.
