jury trial before the justice and trial before him, either party
shall feel aggrieved, there shall be a right of appeal to the
Circuit Court for Frederick county; in case the judgment of
the justice of the peace is against the accused, and he shall
appeal, he shall enter into a recognizance, with security to
be approved by the justice of the peace; and in every such
case the appeal shall be taken within ten days after judgment
entered; provided, however, that any person charged with any
of the above named offenses may at any time before trial before
any such justice of the peace, waive a hearing, and ask in writ-
ing to be admitted to bail, or committed in order that the
grand jury for Frederick county at the next term of the Cir-
cuit for said county mar investigate the charge against him,
her or them, in which event said justice of the peace shall
comply with the law providing for the committing or bailing
of parties held for the action of the grand jury.

SEC. 2. And be it enacted, That this Act shall take effect on
the first Monday in May in the year 1908, and that all Acts
or parts of Acts inconsistent herewith are hereb}7 repealed.

CHAPTER 94.

AN ACT to repeal section 311A of article 11 of the Code of
Public Local Laws of the State of Maryland, title "Frederick
County," as passed by the General Assembly of Maryland,
January session, 1902, chapter 500, and to re-enact the same
with amendments.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That section 311A of article 11 of the Code of Public
Local Laws of the State of Maryland, title "Frederick County,"
as passed by the General Assembly of Maryland, session of
1902, chapter 500, be and the same is hereby repealed and re-
enacted so as to read as follows:

311A. No person having a license to sell spirituous or fer-
mented liquors at any place in Frederick county shall know-
ingly sell or give any spirituous or fermented liquors to any
drunkard or to any person at the time visibly affected by in-
toxicating drinks; nor shall he sell, or give, any spirituous
or fermented liquors to any persons, whose parent, guardian,
wife, husband or other relative on whom the support of the
family, of which such person shall be a member, may depend,
shall have given such licensee a notice in writing that such
person is of intemperate habits.
