668 LAWS OF MARYLAND.

SEC. 6. And be it enacted, That if the County Commission-
ers have determined who is the owner or keeper of any dog
which if found to have worried, maimed or killed any sheep,
lambs, fowls or other domestic animals, thereby causing dam-
age for which their owners may become entitled to compensa-
tion from the dog license fund as provided for in section four,
they shall serve upon the owner or keeper of such dog a notice
directing him within twenty-four hours to kill or confine the
dog.

SEC. 7. And be it enacted, That it shall be lawful for the
County Commissioners of Calvert county, or their agents there-
to, authorized in writing to enter upon the premises of the
owner of any flog to them known to have worried or killed
sheep, lambs, fowls or other domestic animals, and then and
there kill such dog unless such owner whose premises are thus
entered for the said purpose shall give bond in the sum of one
hundred dollars, with sufficient sureties to be approved by the
County Commissioners, the condition of the bond being that
the dog shall refrain from killing or worrying sheep, lambs,
fowls or other domestic animals for the space of twelve months
next ensuing. And if the owner of the dog declares his inten-
tion to give such a bond, the said County Commissioners, or
their agents, shall allow him reasonable time in which to pro-
cure and prepare the same and to present it to them.

SEC. 8. And be it enacted, That a person who owns or keeps
a dog who has received such notice as provided for in sections
six and seven, and does not within twenty-four hours kill such
dog or thereafter keep it on his premises or under the immediate
restraint and control of some person, shall be punished by a fine
of not more than twenty-five dollars, and any person may kill
such dog if it is found strolling outside of the enclosure or im-
mediate care of the owner or keeper.

SEC. 9. And be it enacted, That any person may kill a dog
found out of the enclosure or immediate care of the owner or
keeper worrying, maiming or killing sheep, lambs, fowls or
other domestic animals.

SEC. 10. And be it enacted, That the owner or keeper of a
dog, which is doing damages to sheep, lambs, fowls or other
domestic animals shall be liable in an action of tort to the
county, for all damages so done which the County Commission-
ers have ordered to be paid, as provided in this Act. The State
or District Attorney may, and if so ordered by the County
Commissioners, shall bring said action.

SEC. 11. And be it enacted, That all moneys which are re-
ceived by the County Treasurer under the provisions of this
