439. If any person at any time shall use or have in his
possession, or sell, or dispose of, any sink-boat, sneak-boat,
float, or big or swivel gun, with the intent and for the purpose
of snooting at or killing any wild ducks or water fowl of any
kind, in any of the waters of Baltimore or Harford counties,
or of the Chesapeake bay, adjacent thereto, up to the middle
of said bay, every such person shall be deemed guilty of a
misdemeanor, and on conviction of having violated this sec-
tion shall pay a fine of not less than fifty dollars nor more
than two hundred dollars for each and every offense; and the
possession or sale or disposition by any person of any sink-
boat, sneak-boat, or big or swivel gun, in either of said coun-
ties, or the water aforesaid, shall be deemed prima facie evi-
dence of its being possessed, or sold, or disposed of, with the
intent and for the purpose of shooting at or killing wild ducks
or other water fowl in the said waters; and any big or swivel
gun found at any place in either of said counties, unclaimed,
may lawfully be seized by any person and destroyed or ren-
dered useless.

440. If any person shall shoot at or kill any wild duck
or other water fowl of any kind, in any manner, whether from
the shore or otherwise, in the night time, in, on or over the
waters aforesaid, or the shores thereof, every such person,
whether engaged therein directly or indirectly shall be deemed
guilty of a misdemeanor, and on conviction of having vio-
lated this section shall pay a fine of not less than fifty
nor more than two hundred dollars for each and every of-
fense, and if it shall be proved that the party charged with
shooting at or killing any wild duck or other water fowl in
the night time, was at or about the place at which a shot was
fired, and that he had a gun in his possession on the night in
question, in the vicinity thereof, either prior to, at the time of,
or after such firing, such facts shall be deemed prima facie
evidence of his having violated the provisions of this section.

441. If any person shall shoot at or do any act or thing
whatsoever with the intent and for the purpose of frightening
and driving wild ducks or water fowl of any kind from their
feeding or roosting grounds on said waters, every such person
shall be deemed guilty of a misdemeanor, and on conviction
of having violated this section shall pay a fine of not less than
fifty dollars nor more than two hundred dollars for each and
every offense.

442. If any person shall, in, on or over the waters afore-
said, erect or cause to be erected any booby blind or artificial
