. so as to free his property from said lien claim, and in such case,
unless said Mayor and City Council shall issue a scire facias
thereon against said party within sixty days after the receipt
of such notice, said lien shall be waived and avoided as against
his property, and in all cases of writs of scire facias issued
under this section, the same shall stand for trial at the first
term of court after the issuing thereof; provided, the same shall
have been served on the defendants and a return of such ser-
vice made by the sheriff at least ten days before the commence-
ment of said term, and upon all judgments rendered in such

cases there shall be a stay of thirty days and no longer; pro-
vided, that either party may appeal to the Court of Appeals of
Maryland from any ruling or decision of any question of law
decided by the Circuit Court in such trial. And in case the de-
fendant shall appeal and file a proper appeal bond then said
stay of thirty days shall be counted from the affirmance of such
judgment, if the same shall be affirmed, and not from the date
of the judgment below.

70s. And be it further enacted, That all rights, title and
interests heretofore acquired by the Mayor and City Council
of Cumberland, or any other persons or corporations, in and
about all liens for paving, grading, curbing or re-paving, re-
grading, re-curbing or otherwise improving the said streets,
lanes or alleys of said city, under said chapter 62 of the Acts
of the General Assembly of Maryland passed at its January
session in the year 1904, and all remedies provided therein in
relation to the same are hereby saved and preserved; to be
availed of by the said Mayor and City Council or any other
persons or corporations as fully and to the same extent as
though this Act had not been passed, and nothing in this Act
shall be construed as in any manner impairing the validity of
any such liens which have already accrued under said Act, nor
as depriving said Mayor and City Council, or other persons or

corporations, of any of their rights or remedies thereunder in
relation to the same. But all the rights and remedies shall
remain and be enforceable under said Act the same as though
this Act had not been passed.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.
