proper; and the said policemen and treasurer appointed under
this Act shall, before entering upon the duties of their respec-
tive offices, make oath before said Mayor that they will faith-
fully and impartially perform the duties required of them, re-
spectively, according to the best of their skill and judgment,
without favor, affection or prejudice, and in addition, the said
treasurer shall give such bond as may be approved of by said.
Mayor and Council for the faithful performance of his duties.
SEC. 5. And be it enacted, That the Mayor elected under this
Act shall preside at all meetings of the Council, execute ordi-
nances passed by said Council, and who shall be ex officio
chairman of all committees of said Council, which said com-
mittees shall be appointed by the said Mayor; they may meet
as often as occasion may require and not less than once a
month; and said Mayor and Councilmen, or a majority of
them, shall define the duties of the clerk and the bailiff, and
allow them such compensation for their services as they may
think proper; and all ordinances passed by the Council or a
majority of them, shall be entered by the clerk in a book kept
for that purpose, and shall at all times be open for the inspec-
tion of any person or persons interested, and copies of all ordi-
nances, within thirty days after their passage, shall be posted
in at least three public places in said town, one of which shall
be at the place of meeting of the said Council. For official mis-
conduct or neglect of duty of the bailiff or the clerk, during
their respective terms of office, the said Council may remove the
clerk or bailiff so offending, and shall elect some other person
or persons to fill the office or offices thus made vacant, for the
unexpired term; provided, however, that the said clerk or
bailiff must have at least ten days' notice of the intention of
said Council to act upon the charges of misconduct or neglect
of the said clerk or bailiff, together with a copy of the charges
against the said clerk or bailiff, and they shall be entitled to a
hearing before the said Council before action is taken thereon.
SEC. 6. And be it enacted. That the Mayor and Council of
Barton shall appoint every year, at least ten days before the
day of holding the election, three judges, to hold said election;
they shall keep the polls open from six o'clock P. M. to eight
o'clock P. M., and shall conduct said election in the same
manner as the State and county election are usually conducted,
and the said judges shall make returns, under their oaths,
hands and seals to the clerk of the Circuit Court for Allegany
county of the persons so elected and the position to which they
are elected.
