ACT. 65. ] MILITIA. 203

SEC. 63. The force organized as prescribed in this Act shall
be considered in the actual service of this State, and the mem-
bers thereof shall be subject to all such military rules and regu-
tions as are applicable to all such bodies in time of peace, and
all military offenses such as disobedience of orders, non-attend-
ance at drills, assemblies, parades, reviews or encampments,
or cruises, or neglect or non-performance of such other duty
as they may be lawfully called upon to perform, or conduct to
the prejudice of good order and military discipline, shall be
considered and they are hereby declared to be offenses against
the general police regulations of the State, and shall be pun-
ished by fine or imprisonment as hereinafter provided.

SEC.. 64. Any enlisted man of the Maryland National Guard
committing any of the offenses mentioned in Section 63 of this
Act, and adjudged guilty of the same by a properly constituted
summary, field or general court-martial, shall be liable to and
forfeit and pay the following fines and penalties: (a) For
neglect or refusal to attend assembly of his regiment, battalion,
troop, company, division or separate organization ordered by
the commanding officer thereof, the sum of fifty cents for each
offense. (b) For every day of non-attendance at any encamp-
ment, practice march, rifle practice or cruise ordered by the
Governor, Brigade Commander or by any other competent com-
manding officer, the sum of fifty cents per day. (c) For each
and every other offense provided for in Section 63 the sum of
one dollar, (d) Every officer guilty of any of the offenses or
neglects above set forth shall be subject to a fine of twice the
amount which would be payable by an enlisted man for the
same offense, (e) No excuse shall be valid for any of the above
mentioned absences from such assemblies, except bona fide
absence from the city or place where such assemblies are
ordered, illness of member (such as would prevent attention to
ordinary pursuits), or sickness in family requiring his personal
care and presence; provided, however, that the court may, in
its discretion, excuse the absence for any other reason satis-
factory to it. (/) No excuse will be valid for absence from
annual inspection, except illness of member such as would
prevent his attendance or illness in family requiring his pres-
ence and personal care.

SEC. 65. The commanding officers of the several regiments
and separate organizations of the Maryland National Guard
shall appoint courts-martial in accordance with the regula-
tions made by the Governor for the trial of offenses and the
imposition of fines prescribed in Sections 63 and 64 of this Act,
and the offender shall be entitled to a hearing before the court-
martial so constituted. Upon the finding of any such court-
