PRIVATE ACTS. 1485

Anne Arundel county, if, in the judgment of a majority of
said committee, they deem such purchase advisable, or in the
event that they deem it inadvisable or being impossible, then
it should be the duty of the said committee to purchase a lot
within one mile of the present location and to erect thereon
a suitable building for the use of said institution; and pro-
vided, that the said Patapsco Academy shall have the use of
said building and ground so purchased, or purchased and
erected, as the case may be, upon condition that the said
academy keep in repair, properly insure and protect the said
building.

SEC. 2. And be it further enacted. That the sum of twelve
hundred dollars be and the same is hereby appropriated, and
shall be paid during the year 1908, to the committee hereinbe-
fore named, out of any funds in the Treasury not otherwise
appropriated, and the money now paid by the School Com-
missioners of Anne Arundel coiinty for the support and main-
tenance of said academy, out of the funds appropriated by the
General Assembly of Maryland by chapter 268 of the Acts of
1856, be paid by them unto the said committee to assist in the
payment of an instructor and the maintenance of said insti-
tution as heretofore; and provided further, that said com-
mittee shall elect a chairman from their number and that two
members of said committee shall constitute a quorum with full
power and authority to transact any and all business in con-
nection with the duties thereof.

SEC. 3. And be it further enacted, That the said committee
shall make full report to the next General Assembly of Mary-
land of their proceedings and actions in the premises.

SEC. 4. And lie it further enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 384.

AN ACT to repeal and re-enact with amendments sections 7
and 9 of chapter 257, Acts of the General Assembly of
Maryland, session of 1904, entitled An Act to incorporate
the Baltimore and Southwestern Railroad Company.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That sections 7 and 9 of chapter 257 of the Acts of the
General Assembly of Maryland, session of 1904, entitled "An
Act to incorporate the Baltimore and Southwestern Railroad
Company," be and the same is hereby repealed and re-enacted
with amendments so as to read as follows:
