clerk for a license to keep an oyster house, cook shop, victual-
ling house, tavern, lager beer saloon or any ordinary license
to sell spirituous or fermented liquors; and if the proposed
place of sale is located in Hagerstown or within one and one-
half miles of the corporate limits thereof, the sum of five hun-
dred dollars in addition to the sum required by law to sell
such liquors under the provisions of article 56 of the Code of
Public General Laws. If the proposed place is located out-
side of Hagerstown, at a greater distance than one and one-
half (1 1/2) miles from the corporate limits of said Hagers-
town, the sum of two hundred and fifty dollars, in addition
to the sum required by law, to sell such liquors under the pro-
visions of Act 56 of the Code of Public General Laws of
the State of Maryland, as well as the further sum of fifty
cents as a fee to the clerk; provided, that if there be any remon-
strance filed against the issuing of such license to any one
petitioning therefor, the same clerk shall not issue the same,
and the Circuit Court for Washington county shall fix the
date as early as practicable when said petition and remon-
strance shall be heard and the said court shall, in its discre-
tion, whenever in its opinion the petitioner or petitioners is or
are unfit person or persons to be granted such license, or in
the discretion of the court, the place for which the said license
is applied for is not the proper one with reference to the
location of any of the public schools or churches of the county,
or if the petitioner has not complied with all the prerequisites
of this Act, direct said clerk not to issue the same, but if said
court shall determine that said license shall be issued, then
the clerk shall issue the same, and the judge hearing said
petition and remonstrance shall place the costs of such hear-
ing as he may deem equitable and just; provided, that no
license under this Act shall be issued to any applicant therefor
until the license fee hereinbefore provided for shall have been
paid and the bond given, filed and approved.

SEC. 322. And be it enacted, That no license to sell spir-
ituous, fermented or intoxicating liquors or lager beer in said
Washington county shall be granted to any other person or
persons than those who are citizens of the United States and
a resident or residents of Washington county for one year as
aforesaid, except that such license can be granted to a person
or persons who have not resided in said county for one year;
provided, said person or persons shall have been a regularly
licensed dealer in said liquors or been in said county for two
years preceding the first day of .May, 1908, and all appli-
cants must be of temperate habits and good moral character
who has or have complied with the provisions and requirements
