1034 LAWS OF MARYLAND.

33. The possession by any person within the said county of
any woodcock, (pheasant, partridge, wild turkey, deer, squirrel
or rabbit, out of season, as provided by section 31 of this arti-
cle, or the possession by any express or transportation com-
pany, of any such birds or game out of season, shall be conclu-
sive evidence to convict under said section.

34. Any person or persons or corporations offending against
any of the provisions of sections 29, 30, 31, 32 and 33 of this
article shall be deemed guilty of a misdemeanor, and upon
conviction thereof before a justice of the peace of said county,
shall be sentenced to pay a fine of fifty dollars for each offense,
and upon failure to pay the same shall be committed to the
county jail for a period of thirty days; one-half of said fine to
go to the informer, and the other half to tb.e school fund of the
county; provided, that the party charged shall be entitled to
demand a jury trial before the case is heard by the justice of
the peace, and upon such demand shall be recognized to appear
at the next term of the Circuit Court for said county; and pro-
vided further, that for the purpose of the strict enforcement
of the aforesaid provisions in said sections 29, 30, 31, 32 and 33
of this article, every owner, tenant and other persons in pos-
session of lands or premises in said county whereon such un-
lawful hunting shall be done, and all constables, game wardens,
sheriffs and deputy sheriffs of said county shall have full
power to apprehend and search any person or persons for game
or birds that may be found unlawfully or out of season, on or
about any such person or persons, and arrest any such person
or persons so violating any of the provisions of the aforesaid
sections and any person or persons who shall resist arrest or
search as aforesaid by such owner, tenant or other person in
possession or occupancy of the land, or premises whereon he or
they may be apprehended or any other of the aforesaid officers
shall be liable to be tried and punished as at common law for
resistance to an officer in the discharge of his official duties.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 107.

AN ACT to add an additional section to chapter 745 of the
Public Local Laws, entitled "Washington County," sub-title
"County Commissioners," the same to be known as section
6A, so as to read as follows:
