LAWS OF MARYLAND.

Effective.

SEC. 3. And be it further enacted, That this Act shall take
effect from the date of its passage.

Approved April 9, 1898.

CHAPTER 278.
AN ACT to authorize the conveyance and transfer of certain
property in Fairmount District, in Somerset County, known
as the Fairmount Academy property to the trustees of Fair-
meant Academy, and to authorize the Comptroller of the
Treasury to pay to the said trustees, the money appropriated
by any Acts or Resolntions of the General Assembly.
WHEREAS, Thomas E. Ballard and Rosina Ballard. his wife,

by their deed dated the 6th day of April, A. D. 1867, conveyed
certain property therein described, near Fairmount, in Somerset
county, unto William Muir, John H. Ford, Daniel H. Maddox,
Lazarus Miles, Algie Whittington, William E. Ford and Wil-
liam H. Parks, to have and to hold the same in and for the use
and purposes of a school house or academy for the education
of youth ; and
WHEREAS, The said parties, though holding for a public use,

are not incorporated, and are not provided with the means of
perpetuating their own succession ; therefore,

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That William E. Muir, Joseph Muir, W. Scott Chelton,
Z. Taylor Chelton, Franklin E. Cox, John Hall and William

Body
corporate.

E. Ford of Fairmount district, in Somerset county, be and
they are hereby declared to be a body politic or corporate, by
the Dame and style of "The Trustees or Fairmount Academy,"
and by that name shall have perpetual succession, and shall be
capable to sue and be sued, to have and use a common seal,
and the same at their pleasure to alter or break, and to exercise
all the powers and privileges of corporations under the laws of
this State.
SEC. 2. And be it enacted, That the aforesaid William Muir,

conveyed.

John H. Ford, Daniel H. Maddox, Lazarus Miles, Algie Whit-
tington, William E. Ford and William H Parks, or a majority
of the survivors of them, be and they are hereby authorized
and empowered to convey the property named in the aforesaid
deed to the trustees of Fairmount Academy, as hereinbefore
incorporated, who shall hold the same in and for the use and
purpose of a school house or academy for the education of
youth.
