than five hundred dollars per mile where the same shall have
been graded by the said County Commissioners. And in no
case shall such passenger or other railway, railroad or tramway
be constructed upon the graded and macadamized portions of
said road where said portions do not exceed in the aggregate
forty feet in width. And should said County Commissioners
decide to grade less than sixty feet in width of said road as
now laid out, said graded portions shall be located either upon
the east side or the west side of said road as now laid out
through its entire length. Failure to grade said road to the
full width of sixty feet, as now laid out, shall not be construed
as an abandonment by the said County Commissioners of that
portion of said road not actually graded, but the same shall
remain vested in said County Commissioners subject to such
uses as the public interest may require in the discretion of said
County Commissioners. The grade of any passenger railwav,
railroad or tramway constructed over or along the bed of said
road under the provisions of this section shall conform to the
grades of said road as established by the County Commissioners,
and such passenger or other railway, railroad or tramway shall
be constructed and laid in such manner as to allow safe, free
and easy access to said public county road by persons living
along the route of the same, and having to cross the track or
tracks of such passenger or other railway, railroad or tramway
to reach the same.

Effective.

SEC. 8. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 258.
AN ACT to appropriate a sum of money to assist in defray-
ing expenses of further remodeling, repairing and putting in
condition for use as an Armory for the Fourth Regiment,
Maryland National Guard, the building formerly known as
the "Western Female High School, situate on West Fayette
street, near Paca, in the city of Baltimore, and for the sup-
port and maintenance of said regiment.

SECTION 1. Be it enacted ly the General Assembly of Mary-
land, That the sum of twenty-six thousand five hundred dollars
be and the same is hereby appropriated to assist in further
defraying expenses in repairing, remodeling and putting in
condition for use as an armory for the Fourth Regiment, Mary-
