.same shall become due, and said County Commissioners shall
cause to be levied upon and collect from the taxable property
of the fourth and seventh election districts of said county as
a special improvement road tax for said turnpike road, an addi-
tional tax annually, which shall be sufficient to pay two-fifths
of the said bonds as the same shall severally mature and the
interest thereon as the same shall become due, which said three-
fifths and two-fifths tax shall be collected in like manner as
other taxes levied in said county are collected, and when col-
lected shall be applied to the payment of said bonds as they
mature, and the interest thereon semi-annually.

SEC. 5. And be it enacted, That all coupons of said bonds

for any current year shall be received in payment of county,
taxes in Montgomery county, for such current years or any
previous year, when such coupons shall have matured ; and
when any of said bonds shall have been paid, as herein pro-
vided, the said County Commissioners shall immediately
destroy the same and all immature coupons thereto attached,
and shall also destroy said coupons as they are severally paid,
and should the said County Commissioners, or any person hav-
ing the custody of said bonds or coupons as they have been
redeemed, re-issue the same, the person or persons so offending
shall be deemed guilty of larceny, and shall be punished in
the same manner as is provided for the punishment of that
crime by Article 27 of the Code of Public General Laws, and
shall also be liable civilly in an amount equal to the amount of
said bonds or coupons so re-issued, and the costs of suit.
SEC. 6. And be it enacted, That the County Commissioners
of Montgomery county be and they are hereby authorized and

railroad or tramway over and along said road bed without receiv-
ing just compensation therefor, and in no case less than two
hundred and fifty dollars per mile where said road shall not
have been graded by the County Commissioners, and not less
