material, employ lighters and other necessary labor, and to

make such needful provisions therefor, and to make such
alterations from time to time as they may deem ' proper
or necessary, with the power to contract with any per-
son, corporation or association for snch lighting ; provided,
that the cost under any such contract or lighting shall not
exceed the sum of seven thousand dollars for any one year,
nor shall such contract be made for a period exceeding ten
years; and to provide the amount of money necessary to pay
the cost of any such contract or lighting, the Mayor and
Council are hereby authorized and directed annually to levy
on the assessable property of the town ten cents on every one
hundred dollars' worth of assessable property in said town, and
the money collected from said levy shall constitute a separate
fund, to be kept by the collector of taxes, and be applied to
the payment of .all cost or charges under said contract or light-
ing, and to and for no other use or purpose, said fund to be
placed and drawn out by said Board of Street Commissioners
as directed by section 167 of the charter of Hagerstown ; and
in case the said levy should not be sufficient to pay the cost of
such contract or lighting, the Mayor and Council is hereby
authorized and required to levy and appropriate of the thirty
cents tax authorized by section 195 of this article, and not other-
wise appropriated by said section, as much thereof as may be
necessary for the purpose of raising the amount to be paid
under any such contractor lighting, and the said sum of money
so collected from said tax as aforesaid, appropriated and levied
with the sum received from pro rata apportionment to the same,
as provided by section 166, shall constitute a separate fund to
be kept, applied and drawn in the same manner and form as
the amounts collected from the said levy of ten cents.

as they may direct, such compensation not, however, to exceed
forty dollars per month, and said policemen shall be subject to
removal for cause ; they shall have power to appoint special
policemen if in their judgment the exigencies of the town
shall require it; provided, however, that the term of appoint-
ment of such special policemen shall not extend beyond a
