son for whom it is made is actually sick, or such liquor is actu-
ally required as a medicine ; and any physician who shall make
or sign any prescription for such liquor, except as aforesaid,
/shall be deemed guilty of a violation of said section, and upon
conviction thereof shall be fined not less than fifty dollars nor
more than two hundred dollars for the first offense, and not less
than two hundred nor more than five hundred dollars for each
subsequent offense, one-half of said fine to be paid to the in-
former, the other half to the Board of School Commissioners
of said county, for the use of the public schools situated in the
town of Brunswick ; and upon failure to pay the said fine shall
be committed to the jail of said county until said fine and costs
are paid ; nor shall anything herein be construed to prohibit
the sale by such pharmacist or druggist in case of extreme ill-
ness when delays may be dangerous to the patients.

Effective.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 496.
AN ACT to repeal and re-enact with amendment Chapter
462 of the Acts of 1894, which repealed and re-enacted with
amendments Section thirty-five of Article ninety-three of
the Code of Public General Laws of Maryland, title "Testa-
mentary Law," sub-title "Administration."
SECTION 1. Be it enacted by the General Assembly of Mary-
land That chapter 462 of the Acts of 1894, which repealed

and re-enacted with amendments section 35 of Article 93 of
the Code of Public General Laws of Maryland, title "Testa-
mentary Law," sub-title "Administration," be and the same is
hereby repealed and re-enacted, so as to read as follows :

ary granted
to any
judge.

35. No administration or letters testamentary on any will
executed after the passage of this Act shall be granted to any
judge of the Orphans' Court, or of the Circuit Court, or
Register of Wills of the county where he is judge or Register
of Wills, unless he be next of kin or largest creditor.

Effective

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.
