of said corporation, or any under bailiff thereof, to arrest
any person charged with violating any of the ordinances
of said town and have the offender brought before him for
trial ; he shall also have power to summon witnesses and to
enforce their attendance, both for the corporation and the

accused, by attachment as in like cases before justices of the
peace. But in all cases the person convicted of violating any
ordinance of said town shall have the right of appeal to the
Circuit Court for Frederick county ; provided, the person
appealing shall pray the appeal forthwith and shall give a good
and sufficient bond, to be approved by the police justice, Mayor
or other person trying the case for the payment of the fine
imposed and all costs incurred in the prosecution and appeal,
in case the conviction shall be sustained in the Circuit Court
aforesaid. The person before whom any case for the violation
of any ordinance of said town shall be tried, shall be entitled
to receive the same fees as a justice of the peace would receive
for similar services.
27. If any offender shall be in default for the non-payment

of any fine and costs imposed, he may be proceeded against in
a civil action in the name of the Mayor and Council of Bruns-
wick in the same manner as suits are brought to recover small
debts, and if the fines and costs shall be collected or paid, the
offender shall be immediately released from imprisonment, if
he shall have been committed to prison, whether the term of
his sentence shall have expired or not.

28. The commissioners of the county, justices of the peace,
sheriff, constables and all other county and State officers shall
have, hold and exercise their offices and jurisdiction in said
town.

29. The Mayor and Councilmen and all other officers of the
town in office at the date of this Act' shall hold their offices
until their successors are elected or appointed, as herein pro-
vided, and no longer.
30. The Council shall have full power to regulate privies and

to regulate the character of boxes or other fixtures for them,
and the mode in which they shall be emptied and their con-
tents removed, and shall prohibit the maintenance of privy
sinks, cesspools or other depositions of filth within the corpo-
rate limits.

31. The Council may pass suitable ordinances for the protec-
tion of public buildings, churches, cemeteries, private build-
ings, shops, trees and fencing in said town, from defacement or
