the Mayor nor any member of the Council shall, during his term
of office, be employed by the corporation in any other than
his official capacity, for compensation, nor shall either or any
of them furnish any labor or materials to the corporation
unless the contract to furnish the same be allowed him or them
after competitive bidding, and whenever the opening, grad-
ing, piking or paving of any street or streets, or part of any
street or streets is to be done, or work of any nature is to be
performed, the estimated cost of which shall exceed one hun-
dred dollars, which estimate shall be entered on the minutes
of the Council, notice shall be given that bids will be
received for said work, and the contract shall be awarded
to the lowest responsible bidder, who shall give bond, or
the Council may reject all the bids and advertise anew,
and may in any other case where the estimated cost of the
work is less than one hundred dollars, award the contract for
the same to the lowest competitive bidder, in their discre-
tion.

Bond given.

16. The clerk and the bailiff shall give bond to the Mayor
and Council of Brunswick, in such penalty and with such secu-
rity as may be required, conditioned for the faithful perform-
ance of the duties of their respective offices, and the said bonds
shall be approved and recorded in the office of the clerk of the
Circuit Court for Frederick county.

Receive elec-
tion returns.

17. The Council shall receive all election returns, and deter-
mine all questions arising thereon, and any person conceiving
himself aggrieved by reason of such decision, may appeal to
the Circuit Court for Frederick county, which shall hear
and determine the same and determine who shall pay the
costs of appeal. In case of a tie vote in any election
for Mayor and members of the Council, another election
shall be held after ten days' notice, pursuant to the afore-
going provisions in regard to elections. In case of a vacancy
in the office of Mayor or Councilmen by death, resigna-
tion, disqualification or removal from the town, the Council
shall, within ten days thereafter, order a special election to fill
such vacancy.

Power to pass
ordinances.

18. The Council shall have power to pass all ordinances
necessary, (1) for the good government of the town ; (2) to
prevent, remove and abate, or cause to be removed or abated,
all nuisances or obstructions in or upon the sidewalks, streets,
highways, lanes or alleys, drains or water courses, or in or
upon any lot adjacent thereto, and to provide for imposing a
tine upon any person causing, creating or maintaining any such
