highways so designated ; provided, that the right to construct
and operate said railway through and over the streets and
avenues of the city of Baltimore, shall be subject to all pro-
visions, requirements and limitations contained in chapter 132
of the Acts of 1898, which is an Act to repeal and re-enact
Article 4 of the Code of Public Local Laws, title " City of
Baltimore."

Consolidate
with other

SEC. 9. And be it further enacted, That the said corporation
herein incorporated is hereby authorized to consolidate with
such road or roads as it may cross or connect with, upon such
terms as may be agreed upon between them, or such corpora-
tion may purchase, lease or sell to snch crossing or connecting
road or roads, or the same may be leased or acquired by it.
SEC. 10. And be it enacted, That the president and direct-

ors of said corporation, or a majority of them, shall have
power to make and adopt, alter and amend such by-laws, rules
and regulations for the direction and management of said com-
pany as may be in their judgment from time to time necessary
for the purposes of the corporation, provided, they are not
inconsistent with the constitution and laws of the State, and
the provisions of this charter; and the president and directors
of said company, or a majority of them, shall have the power
to employ all snch agents and servants as in their judgment
may be necessary for the construction, maintenance, repair and
preservation of the railway and other property of said com-
pany, and the running of cars and the transportation of passen-
gers thereon, and for the transaction of the business for which
it is incorporated.
SEC. 11. And be it enacted, That the said company be and

it is hereby authorized in order to construct said railway on
such land or property of any individual or corporation, or on
such private right of way of any individual or corporation, as
it may be necessary to occupy, in order to construct said railway
between the points authorized by this Act, and where the con-
sent of the owners of such ground or property cannot be
obtained, a jury shall be summoned by the sheriff of Baltimore
city, or by the sheriff of Baltimore county or of Harford
county or any other county of Maryland, as the case may be,
upon a warrant of a justice of the peace of Baltimore county,
or Harford, or other county as aforesaid, or of Baltimore city,
as the case may be, for that purpose to be issued upon the
application of said company, to condemn said land or property
and assess the damage, if any, for the occupation of such land
or property, and the inquisition thereupon shall be signed by
