lines shall be used only by tongers who take or catch oysters
with tongs worked exclusively by hand ; and any person who
shall take or catch oysters in said waters with any scrape, scoop
or dredge, or other similar instruments, shall be deemed guilty
of a miedemeanor, and upon conviction, shall be fined not less
than fifty nor more than two hundred dollars, and stand com-
mitted to jail until such fine and costs are paid, or they are
discharged therefrom by due process of law.

Effective.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage, and that all Acts inconsistent with
the provisions of this Act be and they are hereby repealed so
far as they are thus inconsistent.

CHAPTER 404.
AN ACT to refund to James F. Kenly, late Collector of
Taxes for the 2d and 6th Election Districts of Harford
County, for the year 1894, a sum of money erroneously paid
by him into the Treasury as such collector.
SECTION 1. Be it enacted by the General Assembly of Mary-

land, That the Treasurer of State of Maryland be and he is
hereby authorized and directed, upon the warrant of the
Comptroller, to pay James F. Kenly, late collector, (as above)
the sum of seven dollars and seventy-nine cents, the amount of
taxes erroneously paid by him into the treasury as such collec-
tor, the same having been recommended by the Comptroller of
the Treasury.

Effective.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 405.
AN ACT to authorize and direct the County Commissioners
of Montgomery County to levy a sum of money to refund
to Edward E. Stonestreet, of said county, certain taxes erro-
neously paid by him.

Levy a tax.

SECTION 1. Be it enacted by ike General Assembly of Mary-
land) That the County Commissioners of Montgomery county
be and they are hereby authorized and directed to levy for the
use of Edward E. Stonestreet, of said county, the sum of
ninety -seven dollars and twelve cents ($97.12,) the amount of
