Chapter 538.
AN ACT to authorize the mayor and city coun-
cil of Baltimore to make an appropriation for
erecting a monument to the memory of Fran-
cis Scott Key, U. S. A., for his patriotic de-
votion to his country, and for his authorship
of the immortal anthem, "The Star Spangled
Banner," during the years of eighteen hun-
dred and twelve and eighteen hundred and
fourteen.
WHEREAS by a resolution passed by the mayor
and city council of Baltimore, approved March
twenty-sixth, eighteen hundred and eighty-

tained by that body of the patriotism of Francis
Scott Key, United States army, during the
bombardment of Fort McHenry, during its
bombardment by the British fleet, in the year
eighteen hundred and fourteen ; whereas,
without a dissenting voice the two branches
of the city council of Baltimore, on the twen-
ty sixth day of March, in the year eighteen
hundred and eighty-eight, passed a resolution
making an appropriation of ten thousand
dollars for erecting a monument to the mem-
ory of Francis Scott Key ; and whereas, under
the city charter, the city council has no power
to make such an appropriation in the absence
of legislative authority ; therefore,
